What is a Transfer on Death Affidavit?
A Transfer on Death Affidavit is a cost-effective probate avoidance tool for real estate. The Affidavit is a deed that allows the owner of real estate to transfer real estate at the time of death to named beneficiaries in the proportions determined by the owner. It has no effect on an owner’s interest in the property during life and can be changed or revoked at any time. The affidavit must comply with Ohio law and be recorded prior to death. Upon death, the named beneficiaries will assume ownership of the property with the recording of an Affidavit and Certified Copy of Death Certificate.
